These Terms & Conditions govern the use of the website www.venere-gallery.com and the purchase of products from VENERE Gallery. By accessing the website or placing an order, you agree to be bound by these Terms & Conditions.


These Terms & Conditions are drafted in accordance with the Dutch Civil Code and applicable European Union consumer protection legislation.

2. Products & Descriptions

 

VENERE Gallery curates and sells vintage and pre-owned jewellery and watches. Each item may be restored or serviced where necessary to preserve its character and functionality.

 

Descriptions, attributions regarding materials, gemstones, makers, origin, or period reflect the best available knowledge at the time of listing. Such descriptions are not to be considered certified or guaranteed unless explicitly stated.

 

Due to the nature of vintage and pre-owned items:

  • Minor imperfections consistent with age and prior use may be present and are taken into account when assessing conformity ;
  • Water resistance of vintage watches is not guaranteed unless explicitly stated;
  • Product appearance may vary slightly due to lighting or display differences

 

Certain visual materials may be enhanced or generated with the assistance of artificial intelligence for editorial purposes. Such materials are provided for illustrative purposes only. The contractual description of the product is set out in the written product listing.

 

 

 

3. Prices & Payment

 

 

All prices are listed in euros (€) and include VAT where applicable.

 

Payments must be made  through secure payment methods and providers offered at checkout.

 

Orders are confirmed once full payment has been successfully completed.
VENERE Gallery reserves the right to refuse or cancel orders in cases of pricing errors, suspected fraud, or other legitimate grounds.

 

 

4. Shipping & Delivery

 

Orders are dispatched within 3–5 business days after payment confirmation.

 

All shipments are sent via DHL GoGreen, including tracking and insurance.

 

Estimated delivery times are indicative. In any event, delivery will take place within 30 days after conclusion of the contract, unless otherwise explicitly agreed.

5. Risk and Ownership

 

In accordance with Article 7:11 of the Dutch Civil Code, the risk of loss or damage remains with VENERE Gallery until the goods have been delivered to the customer or a third party designated by the customer.

 

Ownership of the goods transfers to the customer upon full payment and delivery.

 

 

6. Right of Withdrawal

 

In accordance with Articles 6:230g–6:230z Dutch Civil Code, consumers have the right to withdraw from the purchase within 14 days from the day on which the goods are received, without giving any reason.

 

To exercise this right, the customer must notify VENERE Gallery by means of an unambiguous statement, such as via the contact form on our website or by email.


Upon valid withdrawal:

  • VENERE Gallery will reimburse all payments received, including standard delivery costs;
  • Reimbursement will be made within 14 days from the day on which VENERE Gallery is informed of the withdrawal;
  • VENERE Gallery may withhold reimbursement until the returned goods have been received or proof of return has been provided.

Returned items must comply with the conditions outlined in the Return & Refund Policy, which forms an integral part of these Terms & Conditions.

 

 

7. Returns

 

Returns are subject to the Return & Refund Policy.

 

Returned items must be sent back within 14 days after the withdrawal notification.

In summary:

  • Items must be returned in original condition, with all accompanying documentation and packaging.
  • Return shipping costs are borne by the consumer, unless the item is faulty or not in conformity with the agreement.

 



8. Conformity of Goods

 

VENERE Gallery guarantees that the products conform to the agreement, the specifications stated in the offer, and reasonable expectations of usability and durability, taking into account the nature of vintage and pre-owned items.

 

If a product does not conform to the agreement, the consumer is entitled to statutory remedies, including repair, replacement, or refund, in accordance with applicable law.

 

 

9. Authenticity & Independence

 

VENERE Gallery sells vintage and pre-owned items.

 

Unless explicitly stated:

  • No formal certificate of authenticity is provided
  • VENERE Gallery is not affiliated with any brand or manufacturer

 

All trademarks and brand names remain the property of their respective owners and are used for identification purposes only.

 

 

10. Sustainability

 

VENERE Gallery operates with a focus on sustainability:

  • All items are pre-owned or vintage
  • Packaging is selected to reduce environmental impact

 

 

11. Intellectual Property

 

All content on this website, including but not limited to images, product descriptions, branding, logos, and design, is the property of VENERE Gallery and may not be reproduced, distributed or otherwise used without prior written consent.

 

 

12. Liability


Nothing in these Terms & Conditions shall limit or exclude liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, or the consumer’s statutory rights.

 

To the maximum extent permitted by law, VENERE Gallery shall not be liable for indirect or consequential damages, including the loss of data, revenue, or goodwill

 

To the extent permitted by applicable law, VENERE Gallery's total liability arising from or relating to any purchase shall not exceed the purchase price paid for the relevant product.

 

 

13. Force Majeure

 

VENERE Gallery shall not be liable for delays or any failure in the performance of its obligations due to circumstances beyond its reasonable control, in accordance with Article 6:75 of the Dutch Civil Code.

 

 

14. Age Requirement

 

By placing an order, you confirm that you are at least 18 years old or have permission from a legal guardian.

 

 

15. Changes

 

VENERE Gallery reserves the right to amend these Terms & Conditions at any time.

The version applicable to the order is the version in force at the time of purchase.

 

 

16.   Entire Agreement

 

These Terms & Conditions, together with the Privacy Policy, Shipping Policy, Return & Refund Policy and Legal Notice, constitute the entire agreement between the parties regarding purchases made through the website, unless otherwise required by mandatory law.

 

 

17. Governing Law

 

These Terms & Conditions are governed by the Dutch law.

 

Any disputes shall be submitted to the competent court in the Netherlands, unless mandatory consumer protection law requires that disputes be brought before the courts of the consumers’ place of residence.
